2. Scope of Application
These Terms of Sale apply to all purchases made via the website www.datefrenchmen.com by French and international customers, relating to: digital products and personal coaching services.

 

3. Products
3.1 Digital products
The digital ebooks, eguides, ecard decks + audio and other digital products are not supplied on a physical medium, but delivered by download or digital access after payment. Available formats may include PDF / EPUB / MOBI / MP4 etc.
Digital products are provided under a best-efforts obligation, with no guarantee of specific results.
3.2 Coaching services
Coaching services are provided in the form of: individual sessions online (Zoom).

4. Prices
Prices are indicated in euros (€).
For digital products:
- B2C customers (individuals) within the European Union (excluding France): Prices include VAT at the applicable rate for your country, collected in accordance with the EU OSS (One Stop Shop) scheme
- B2C customers (individuals) in France: Prices include VAT at the applicable French rate

B2B customers (businesses) within the European Union with a valid VAT number: Prices are exclusive of VAT under the reverse charge mechanism

Non-European Union customers: For customers located outside the European Union, prices are displayed at the same rate as those shown to EU customers (TTC) for consistency of presentation. However, in accordance with Article 259-1 of the French General Tax Code, VAT is not applicable to these transactions. No French VAT is charged. The price paid is the net amount. Any local taxes, duties, or charges applicable in the customer's country remain the responsibility of the customer.
For coaching services:
- B2C customers (individuals) within the European Union and in France: Prices include VAT at the applicable French rate, as coaching services are provided from France
- B2B customers (businesses) within the European Union with a valid VAT number: Prices are exclusive of VAT under the reverse charge mechanism
- Non-European Union customers: For customers located outside the European Union, prices are displayed at the same rate as those shown to EU customers (TTC) for consistency of presentation. However, in accordance with Article 259-1 of the French General Tax Code, VAT is not applicable to these transactions. No French VAT is charged. The price paid is the net amount. Any local taxes, duties, or charges applicable in the customer's country remain the responsibility of the customer.

* The same price may be displayed to all customers regardless of location. However, the VAT treatment differs depending on the customer’s country of residence.
* The seller reserves the right to modify prices at any time. However, products and services will be invoiced based on the rates in effect at the time of order confirmation.

5. Discount codes
Discount codes issued with product purchases (including the 1:1 Coaching Session discount code included with the purchase of the ebook) are single-use and non-transferable. They cannot be combined with other offers.

6. Orders
Placing an order implies full and unconditional acceptance of these Terms of Sale. The customer acknowledges having read and understood the essential characteristics of the products and services before purchase. The contract is concluded once payment has been confirmed.

7. Payment
Payment is due immediately and in a single payment, via credit/debit card, Shop Pay, Apple Pay or PayPal. Payments are secure. No subscriptions or recurring payments are offered. The seller reserves the right to refuse or cancel any order in case of suspected fraud or non-payment.

8. Delivery of digital products
The ebooks and eguides and any other digital products are made available by email immediately after payment confirmation, via download or digital access. After payment confirmation of the ecard deck + audio, the introduction and Day 1 card is immediately made available by email via download or digital access, followed by one card per day for 89 days. The emails sent as part of the ecard deck + audio are strictly necessary for the execution of the contract and do not constitute marketing communications.
The seller cannot be held responsible for technical issues related to the customer’s equipment or internet connection. It is the customer’s responsibility to provide a valid email address and ensure access to the delivery medium.

9. Delivery of coaching sessions
Coaching sessions are delivered remotely via Zoom video call. Upon payment confirmation, the customer will receive a booking link to schedule their session at a mutually available time.
The customer is responsible for ensuring they have the following in place prior to the session:

A valid and active Zoom account

A functioning device (computer, tablet or smartphone) with a working camera and microphone

A stable internet connection sufficient for video calling

Punctual attendance at the scheduled time
The seller cannot be held responsible for any technical issues on the customer's side, including but not limited to internet connection failures, device malfunctions, or inability to access or operate Zoom. Sessions missed or interrupted due to the customer's technical issues will not be refunded or rescheduled unless agreed otherwise at the seller's sole discretion.
If the seller is unable to deliver the session due to technical issues on their side, the session will be rescheduled at no additional cost to the customer.

10. Right of withdrawal
10.1 Digital ebooks, eguides or any other digital products – Express Waiver
In accordance with Article L221-28(13) of the French Consumer Code, the 14-day withdrawal right does not apply to digital content supplied immediately after purchase, where the customer has given prior express consent and acknowledged the loss of their withdrawal right.
By placing an order for digital content delivered immediately after payment, the customer expressly requests immediate access and acknowledges that their right of withdrawal is waived.
10.2 Digital ecard deck + audio - Staggered delivery - Express Waiver
In accordance with Article L221-28(13) of the French Consumer Code, the 14-day withdrawal right does not apply to digital content delivered in stages, where the customer has given prior express consent and acknowledged the loss of their withdrawal right.
The ecard deck + audio is delivered over 90 days (introduction and Day 1 immediately after payment, followed by one card per day for 89 days).
By placing an order for this product, the customer expressly requests the start of delivery and acknowledges that their right of withdrawal is waived from the moment delivery begins.
10.3 Coaching services - Express Waiver
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a 14-day withdrawal period from the date of purchase.
However, where a coaching session is scheduled to take place within this period, and the customer has expressly requested that the service be performed before the end of the withdrawal period, the right of withdrawal will be lost once the session has been fully completed.
By scheduling a session, the customer expressly acknowledges that if the session takes place within the 14-day withdrawal period, their right of withdrawal will be lost once the session has been completed.

11. Rescheduling of coaching sessions
Once the 14-day withdrawal period has expired, or where the customer has expressly waived it by scheduling a session within that period, the following condition applies: coaching sessions may be rescheduled provided that notice is given at least 24 hours in advance. In the absence of such notice, if the customer does not attend the session, the session will be deemed delivered and the full amount remains due, including for international clients. 

12. Refund policy
This refund policy applies subject to the consumer rights described in Article 10 (Right of withdrawal).
No refunds will be granted:
- for digital ebooks, eguides or any other digital products once access or download has been provided
- for the ecard deck + audio once the introduction and Day 1 card have been delivered, as delivery of the full product has commenced
- for coaching sessions where the 14-day withdrawal period has expired or been waived
- for coaching sessions that have started or been completed
Any exceptional refund will be processed within 14 days.

13. Liability
The ebooks, eguides, ecard deck + audio and other digital products and coaching services are provided for educational and informational purposes only, based exclusively on my personal experience and knowledge. Both digital products and coaching services do not constitute professional, medical, psychological, legal or financial advice. The seller makes no guarantee of results and shall not be held liable for indirect damages or for the use or interpretation of the content, except where liability cannot be excluded under applicable law.

14. Intellectual property and anti-piracy
All ebooks, eguides, ecard decks + audio, coaching materials, methods, texts and content are protected by intellectual property laws. All digital content provided is strictly personal, confidential and non-transferable.
14.1 Digital ebooks, eguides, ecard decks + audio or any other digital products
Without prior written authorisation, it is strictly prohibited worldwide to:

Share, copy or distribute any digital content
-
Upload it to public or private platforms (including file-sharing sites, torrent sites or social media)
-
Resell, rent or transfer it to any third party
-
Reproduce or disseminate all or part of the content, free of charge or otherwise
14.2 Coaching services
During 1:1 coaching, customers may take notes and create audio recordings for their personal use only. Video recording of the coach is strictly prohibited. All recordings, notes, and session content are confidential and may not be shared, sold, distributed or used for any commercial purpose. The coach retains all intellectual property rights to the coaching methods, advice and materials provided during sessions.
14.3 Enforcement
Any violation may result in:

Immediate termination of access to the content
-
Civil and criminal legal action under applicable intellectual property laws
-
Claims for damages and compensation
The seller actively monitors for unauthorised distribution and will pursue all available legal remedies.

15. Personal data
Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
 Personal data is collected and processed for the purposes of order management, customer relationship management, and service delivery, on the legal basis of contract performance.
 Data may be shared with service providers strictly necessary for the provision of services (such as payment processors and email delivery platforms).
 Data is retained for the duration necessary to fulfill these purposes and to comply with legal obligations.
 Customers have the right to access, rectify, erase, and port their data, as well as the right to restrict or object to processing, by contacting: hello@datefrenchmen.com.
 Customers also have the right to lodge a complaint with a supervisory authority, in particular in France with the CNIL.


16. Consumer Mediation
In accordance with Articles L616-1 and R616-1 of the French Consumer Code, the consumer may have free recourse to a consumer mediation service for the amicable resolution of any dispute.
If you have not been able to resolve your dispute after submitting a written complaint (by post or email), dated and describing the circumstances giving rise to the dispute and the relief sought, you may refer the matter to the consumer mediator designated below, provided that you have received a written negative response from us or have not received any response within two months of your complaint.

This procedure is available to all French and international customers, as long as French law applies.

17. International dispute resolution
For customers residing outside France and the European Union, any dispute relating to the purchase of a digital product or coaching service will, as far as possible, be resolved amicably between the customer and the seller. If an amicable solution cannot be reached, the dispute may be submitted to the competent courts of the seller’s country of residence (France), under applicable French law.

18. Governing law and jurisdiction
These Terms of Sale are governed by French law, regardless of the customer’s country of residence. Any dispute shall fall under the jurisdiction of the competent courts in accordance with applicable legal provisions, in particular those protecting consumers. For consumers residing in the European Union, mandatory consumer protection rules and jurisdiction rights of their country of residence may apply.
